These terms are the agreement between you and Thala. By creating an account or using the app, you agree to them.

Read this first

Thala is a diary, not a doctor. It is not a medical device, it does not diagnose or treat anything, and nothing in it is medical advice. Never delay seeking or disregard professional medical advice because of something you read in the app.

1. Who you are agreeing with

Thala is operated by Thala (sole trader, United Kingdom). In these terms “we” and “us” mean Thala, and “you” means you, the person using the app.

If you do not agree to these terms, please do not use the app. You can contact us at support@thala.online.

2. Who can use Thala

You must be at least 16 years old to create an account. You must give accurate information when you sign up, and you are responsible for keeping your password secure and for everything that happens under your account. Tell us straight away if you think someone else has access to it.

3. Thala is not medical care

This is the most important term in this document.

  • Thala is a general wellness and self-tracking tool. It is not a medical device and has not been assessed or approved by any medicines or medical devices regulator.
  • It does not diagnose, treat, cure, prevent or monitor any disease or condition, and it does not give medical advice.
  • The insights and evidence shown in the app are simple observations about the entries you have made. A pattern is not a cause. It may be a coincidence, and it may be wrong.
  • Always consult a qualified clinician about your symptoms, and before starting, stopping or changing any treatment. Never disregard or delay professional medical advice because of anything in the app.
  • If you are having a medical emergency, or you are thinking about harming yourself, contact your local emergency services or a crisis line immediately. Thala is not monitored and cannot help you.

4. Your entries

Everything you log stays yours. We do not claim ownership of it. We store and process it only to run the app for you, as described in the Privacy Policy, which forms part of these terms.

You are responsible for what you enter. Please do not put other people’s personal or health information into your diary.

5. Acceptable use

You agree not to:

  • Use the app for anything unlawful, or in breach of anyone else’s rights
  • Attempt to access accounts, data or systems that are not yours
  • Reverse engineer, decompile or tamper with the app, except where the law expressly permits it
  • Interfere with the service, or place an unreasonable load on it, including by automated scraping or bulk requests
  • Copy, resell or redistribute any part of the app

6. Availability and changes

We aim to keep Thala working and available, but we do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw features, and we may need to take the service down for maintenance. If we ever discontinue the app entirely, we will give reasonable notice so that you can retrieve your data.

7. Ending your account

You can delete your account at any time from inside the app. See the account deletion page. Deletion is immediate and permanent.

We may suspend or end your access if you materially breach these terms, or if we are required to by law. Where it is reasonable to do so, we will tell you first.

8. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under the law that applies to you. If you are a consumer, you keep all the statutory rights the law gives you, and these terms do not affect them.

Subject to that: the app is provided “as is”, we do not promise that it will meet any particular need or produce any particular result, and we are not liable for indirect or consequential loss, loss of data, or loss arising from any decision you make on the basis of what the app shows you.

9. Intellectual property

The app, its name, its design and its content belong to us or our licensors. Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own personal, non-commercial purposes.

10. Your agreement is with us, not Apple

These terms are between you and Thala only, not with Apple. Thala, and its content, is our sole responsibility and not Apple’s.

11. Scope of licence

The licence granted in section 9 is a licence to use Thala on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Thala may be accessed by other accounts associated with you via Family Sharing or volume purchasing.

12. Maintenance and support

We are solely responsible for providing any maintenance and support for Thala, as specified in these terms or as required by law. Apple has no obligation whatsoever to provide any maintenance or support for Thala.

13. Warranty and product claims

In the event of any failure of Thala to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Thala.

We, not Apple, are responsible for addressing any claims relating to Thala or your possession and use of it, including: product liability claims; any claim that Thala fails to conform to any applicable legal or regulatory requirement; claims arising under consumer protection, privacy or similar legislation; and any third-party claim that Thala infringes that party’s intellectual property rights.

14. Apple as third-party beneficiary

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these terms, and that upon your acceptance of these terms Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

You also represent and warrant that you are not located in a country subject to a US Government embargo, or designated as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.

15. Changes to these terms

We may update these terms as the app changes. We will update the date at the top of this page, and for significant changes we will tell you in the app. Continuing to use Thala after a change means you accept the updated terms.

16. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the UK or the EEA, you keep the benefit of any mandatory protections of the law of the country you live in, and you may bring proceedings there.
